Utah has some of the most comprehensive alcohol compliance laws in the United States. As of January 1, 2026, businesses that sell alcohol face stricter identification requirements than ever before, and the consequences for non-compliance are serious.
Under House Bill 437, every establishment licensed to sell alcohol in Utah must now verify identification for every customer purchasing alcohol, regardless of age. There are no exceptions. Whether a customer looks 25 or 75, they must present a valid government-issued ID before alcohol can be sold.
This universal ID check requirement applies to all license types: bars, taverns, restaurants, convenience stores, grocery stores, and liquor stores. For bars and taverns that already conducted 100% ID checks at the door, the change primarily reinforces an existing practice. Utah’s 100% ID law exists in large part to support a new category of ID: the interdicted person license. Under HB 437, individuals convicted of extreme DUI (defined as driving with a blood alcohol concentration of 0.16% or higher, or 0.05% combined with a controlled substance) are designated as “interdicted persons” and are legally prohibited from purchasing or consuming alcohol during their probation.
These individuals are issued a replacement driver’s license bearing a prominent red stripe above their photo and the words “NO ALCOHOL SALE.” Temporary paper versions carry the same language in black and white. Selling alcohol to someone with this designation is a direct violation of Utah law, regardless of whether the employee noticed the marking.
One important detail for operators: electronic ID scanners do not automatically flag interdicted status. The red stripe is a visual marker and staff must be trained to spot it on every ID they check. This makes comprehensive staff training an essential part of any Utah compliance strategy.

Failing to verify ID, or selling to someone whose ID indicates they are prohibited carries serious criminal and administrative consequences.
Criminal Penalties:
- Class B misdemeanor (negligent sale — failure to verify ID): up to 6 months in jail and a $1,000 fine
- Class A misdemeanor (knowing sale to a minor): up to 12 months in jail and a $2,500 fine
Administrative Penalties:
Under the Utah DABS administrative violation framework, penalties escalate with repeat offenses and can include:
- Serious violations (such as sale to a minor): 1st offense fines of $500–$3,000 and a 5–30 day suspension; repeat violations can reach $25,000 in fines and full license revocation
- Grave violations (such as sale to a visibly intoxicated person): 1st offense fines of $1,000–$25,000, up to revocation
- Three or more sale-to-minor violations can make a business subject to the nuisance retail licensing act

Lawmakers in other jurisdictions are monitoring Utah’s implementation closely, and similar legislation has been discussed elsewhere. Operators with multi-state footprints, or those anticipating regulatory expansion, should be preparing now.
Beyond court-ordered restrictions, Utah’s law also permits voluntary participation: any resident may request a “NO ALCOHOL SALE” designation on their ID as a personal support measure. After a minimum of 30 days, they may request a replacement without the restriction. This means businesses are likely to encounter the red stripe in a variety of contexts, not just DUI cases.
Utah already enforces the strictest DUI threshold in the United States — a 0.05% BAC limit for drivers — and its new ID laws are widely viewed as a testing ground for what other states may adopt next.
