ID Scanning Laws in South Carolina

South Carolina has introduced some of the most significant changes to its alcohol licensing framework in recent years, and as of January 1, 2026, businesses that serve alcohol after midnight face new mandatory ID scanning requirements.

The Late-Night Forensic ID Scanning Mandate

Under South Carolina Code Section 61-2-145(F) (effective January 1, 2026), any licensed business selling alcoholic beverages for on-premises consumption between 12:00 a.m. and 4:00 a.m. is legally required to use a forensic digital identification system to validate the ID of every person attempting to enter the premises. This applies to all on-premises licensees operating during those hours, including: bars, nightclubs, taverns, and any other venue serving alcohol in the late-night window. 

The law is specific about what “forensic” means. A standard barcode reader that simply confirms the barcode matches the front of the card is not sufficient. The South Carolina Department of Revenue (SCDOR) requires systems that go further: analyzing the barcode’s underlying data for typographical errors, jumbled or incorrect data fields, misplaced information, and the secret coding that distinguishes genuine government-issued IDs from sophisticated counterfeits.

Combined with other available mitigation factors, venues could potentially reduce their required coverage to the minimum floor of $300,000, translating directly to real premium savings, year after year. 

Available mitigation factors under Section 61-2-145(E): 

  • Stop serving alcohol by 12:00 a.m. for the entire policy period: −$250,000 
  • All servers complete approved alcohol server training within 60 days of hire: −$100,000 
  • Alcohol sales are less than 40% of total sales: −$100,000 
  • Use a forensic digital ID system between 12:00 a.m. and 4:00 a.m.: −$100,000 
  • Nonprofit organization with a single-event permit: −$500,000 

 

To claim the forensic scanner mitigation factor, venues must submit the make and model of their approved system along with proof of purchase or subscription information to the SCDOR either through MyDORWAY for current licensees, or as part of the new licensing application. Patronscan’s SCDOR approval means venues deploying it immediately qualify for this reduction.

Penalties for Non-Compliance

Failing to use a forensic ID system during required hours (or committing other alcohol compliance violations) carries serious administrative consequences under the SCDOR Penalty Guidelines for ABL Violations (SC Revenue Procedure #26-1): 

Failure to use a forensic ID system (Section 61-2-145(F)): 

  • $750 per violation — applicable to both beer/wine permit holders and liquor licensees 

 

Sale of alcohol to a person under 21 (Section 61-4-580): 

  • 1st offense: $2,500 fine 
  • 2nd offense within 2 years: permit suspension of up to 14 days 
  • 3rd offense within 3 years: permit revocation 

 

Other notable penalties: 

  • Failure to maintain/produce alcohol server certificates: $100 per violation 
  • Permitting uncertified staff to serve alcohol: $500 per violation 
  • Failure to maintain required liquor liability insurance: Indefinite suspension 
  • Hindering or delaying an inspection: $200 + 30-day suspension (1st offense), revocation (2nd offense)
